These Terms of Service ("Terms") govern your use of the WCAGAlert platform operated by WCAGAlert ("we", "us", "our"). By creating an account or using any part of the service, you agree to these Terms.

1. Service Description

WCAGAlert is a web accessibility monitoring tool that scans websites for potential WCAG 2.1 AA violations using automated testing technology (axe-core). We provide scan results, reports, and monitoring dashboards to help identify accessibility issues.

2. Important Limitations — No Compliance Guarantee

Automated scanning detects approximately 57% of WCAG issues. WCAGAlert does not and cannot guarantee full accessibility compliance, legal conformity with the European Accessibility Act (EAA), WCAG 2.1, or any other accessibility standard or regulation. Our service is a tool to assist you — it is not a substitute for manual accessibility testing, expert review, or legal advice.

You are solely responsible for ensuring your websites comply with applicable accessibility laws and standards. WCAGAlert shall not be held liable for any fines, penalties, claims, or damages resulting from reliance on our scan results.

3. Acceptable Use

You agree to:

  • Only scan websites you own or have explicit authorization to scan
  • Not use the service for any illegal purpose
  • Not attempt to overwhelm our infrastructure or abuse rate limits
  • Not resell access to the service without written permission
  • Provide accurate account information

By adding a URL to WCAGAlert, you confirm that you have permission from the website owner to scan it. We reserve the right to suspend accounts that scan unauthorized websites.

4. Accounts and Security

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Subscription and Payments

Paid plans are billed monthly or annually through Stripe. Subscriptions auto-renew unless cancelled before the end of the billing period. You can cancel at any time through your dashboard (Settings → Billing). Cancellation takes effect at the end of the current billing period.

Refunds: We do not provide refunds for partial billing periods. If you believe you have been billed in error, contact us at info@wcagalert.com within 14 days.

We reserve the right to change pricing with 30 days notice. Existing subscriptions continue at the original price until renewal.

6. Intellectual Property

You retain ownership of your data (URLs, scan configurations, branding). We retain ownership of the WCAGAlert platform, software, and documentation. Scan results generated by our service may be used freely by you for any purpose, including client reporting.

7. Limitation of Liability

To the maximum extent permitted by applicable law, WCAGAlert's total liability for any claims arising from or related to the service shall not exceed the amount you have paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, whether based on warranty, contract, tort, or any other legal theory.

We do not warrant that the service will be uninterrupted, error-free, or that scan results will be complete or accurate. The service is provided "as is" and "as available" without warranties of any kind, either express or implied.

8. Indemnification

You agree to indemnify and hold harmless WCAGAlert, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the service ceases immediately. You may request export of your data within 30 days of termination.

10. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 14 days before taking effect. Continued use of the service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved by the courts of Sweden. Nothing in these Terms limits your statutory rights as a consumer under EU law.
